1. Introduction
This Acceptable Use Policy ("AUP") governs your use of Tinker Payments services operated by Tinker Digital Limited (Kenya) and Tinker Digital LLC (USA), collectively referred to as "Tinker Digital," "we," "us," or "our." Tinker Digital Limited is a Private Limited Company registered in Kenya. By using our services, you agree to comply with this AUP in addition to our Terms of Service.
Violation of this AUP may result in immediate suspension or termination of your account, legal action, and reporting to relevant authorities. We reserve the right to modify this AUP at any time.
2. Prohibited Activities
You may not use Tinker Payments services to:
- Engage in any illegal activities or facilitate illegal transactions
- Process payments for fraudulent, deceptive, or misleading purposes
- Launder money or facilitate money laundering activities
- Violate any applicable laws, regulations, or industry standards
- Infringe upon intellectual property rights of others
- Transmit viruses, malware, or other harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of our services
- Use automated systems to abuse or overload our API beyond reasonable limits
- Circumvent security measures or attempt to bypass fraud detection systems
- Collect or harvest personal information from other users without consent
- Impersonate any person or entity or misrepresent your affiliation
3. Prohibited Businesses and Industries
You may not use Tinker Payments services for businesses or activities in the following categories:
- Illegal Activities: Any business or activity that is illegal in your jurisdiction or violates applicable laws
- Adult Content: Pornography, adult entertainment, or sexually explicit materials
- Gambling and Gaming: Online casinos, sports betting, lotteries, or other gambling activities (unless properly licensed)
- Financial Services: Unlicensed money services, currency exchange, cryptocurrency trading, or investment schemes
- Drugs and Pharmaceuticals: Sale of controlled substances, prescription drugs without proper authorization, or illegal drugs
- Weapons and Ammunition: Firearms, ammunition, explosives, or other weapons
- Counterfeit Goods: Sale of counterfeit, replica, or pirated products
- Pyramid Schemes: Multi-level marketing, pyramid schemes, or Ponzi schemes
- Debt Collection: Aggressive debt collection practices or harassment
- Tobacco Products: Sale of tobacco, e-cigarettes, or related products
- Hacking and Surveillance: Hacking tools, surveillance equipment, or services designed to compromise security
- Stolen Goods: Sale of stolen property or goods obtained through illegal means
- Human Trafficking: Any form of human trafficking or exploitation
- Hate Speech: Content that promotes hate, violence, or discrimination
This list is not exhaustive. We reserve the right to prohibit any business or activity that we determine poses a risk to our platform, users, or violates our values or legal obligations.
4. Fraud Prevention and Security Requirements
You must:
- Implement appropriate security measures to protect your account credentials and API keys
- Monitor your transactions for suspicious or fraudulent activity
- Report suspected fraud or security breaches to us immediately
- Verify the identity of your customers before processing payments
- Comply with Know Your Customer (KYC) and Anti-Money Laundering (AML) requirements applicable to your business
- Maintain accurate records of all transactions
- Not process payments on behalf of third parties without proper authorization
- Not use the service to test payment systems without legitimate business purposes
5. API Usage Restrictions
When using our API, you must:
- Comply with rate limits and usage quotas as specified in our documentation
- Not attempt to circumvent rate limits through multiple accounts or automated systems
- Not reverse engineer, decompile, or disassemble our API or services
- Not use the API in a manner that could damage, disable, or impair our services
- Implement proper error handling and retry logic
- Not share API keys with unauthorized parties
- Rotate API keys regularly and immediately revoke compromised keys
- Use webhooks responsibly and ensure your callback endpoints are secure and available
6. Transaction Requirements
You must:
- Only process payments for legitimate goods and services
- Provide clear and accurate descriptions of products or services
- Honor refund and cancellation policies as disclosed to customers
- Not process duplicate or unauthorized transactions
- Not use the service to process payments for your own account (self-payments)
- Comply with all applicable payment card industry standards and regulations
- Maintain proper authorization from customers before processing payments
- Not use the service to test payment systems without legitimate transactions
7. Data Protection and Privacy
You must:
- Comply with all applicable data protection and privacy laws
- Obtain proper consent before collecting or processing customer data
- Implement appropriate security measures to protect customer data
- Not share customer data with unauthorized third parties
- Not use customer data for purposes other than those disclosed and authorized
- Respond promptly to data subject access requests
- Notify us immediately of any data breaches affecting customer information
8. Monitoring and Enforcement
We actively monitor usage of our services to detect violations of this AUP. We may:
- Review transactions and account activity for compliance
- Use automated systems to detect fraud and abuse
- Request additional information or documentation from you
- Suspend or terminate accounts that violate this AUP
- Report violations to law enforcement or regulatory authorities
- Take legal action against violators
9. Consequences of Violations
Violations of this AUP may result in:
- Immediate suspension or termination of your account
- Rejection or reversal of transactions
- Withholding of funds pending investigation
- Permanent ban from using our services
- Legal action and reporting to law enforcement
- Financial penalties or damages
We reserve the right to take any action we deem necessary to protect our platform, users, and comply with legal obligations.
10. Reporting Violations

11. Changes to This Policy
We may update this AUP from time to time. Material changes will be communicated via email or through our Platform. Continued use of our services after changes constitutes acceptance of the updated AUP.
